How to File a Grievance

 

A bargaining unit member has a contractual right under the Collective Bargaining Agreement (C.B.A.) to file a grievance to object to any violation of the CBA by Management. There are three basic types of grievances: workload, ethics-related, and all others.

Most grievable complaints are resolved informally without a grievance filing. Those complaints which cannot be resolved informally may be grieved by filing a formal complaint with Management. The Local has grievance forms available for such use here on this site. The grievance generally must be filed within eight business days of the occurrence or activity the subject of the grievance.

A grievant should consult with his or her Area Representative for advice and assistance. The Grievance Committee may be consulted before or after the filing for additional advice and assistance.

To process a grievance, complete an Official Grievance Form and present it to Management. You may wish to have the manager sign an additional copy for you to retain as proof of timely delivery. Submit a copy of the grievance form and a Grievance Fact Sheet to the Grievance Chair, either directly or through your Area Representative.

The Grievance Chair will schedule a Step 1 meeting in the Local office where the grievant, the Area Rep., and Management will attempt to resolve the grievance. If no resolution is achieved, the Grievance Chair will poll the Grievance Committee to determine whether to move the grievance to higher levels of appeal, including binding arbitration.
